By accessing and using https://chinatravelofficial.com/ (the “Website”) and the services offered (collectively, the “Services”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and comply with all applicable laws and regulations. If you do not agree, please do not use our Services.
2. Description of Services
We, Chinatravelofficial, are an agency providing travel and related services within China for international visitors (“Travelers”), including itinerary planning, bookings, visa advisory assistance, guide services, and arrangements for transportation and accommodation.
3. User Eligibility
You must be at least 18 years old and have full legal capacity to use our Services for making bookings. If you are booking on behalf of others, you guarantee you have their authorization and will provide accurate information.
4. Account Registration and Security
Certain Services may require you to create an account. You are responsible for providing accurate, complete, and current information and for maintaining the security of your account password. You are responsible for all activities under your account.
5. Bookings, Payments, and Pricing
- Quotes: Prices displayed on the Website are indicative. Final pricing will be confirmed upon booking based on specific dates, group size, service level, real-time exchange rates, etc. We reserve the right to adjust prices.
- Booking Process: Submitting a booking request does not constitute a confirmed booking. A booking is only confirmed once you have paid the required deposit or full payment and received a written confirmation (usually email) from us.
- Payment: You agree to pay fees as specified in the booking confirmation using the required method and timeline. Late payment may result in booking cancellation with loss of deposit.
- Currency and Fees: Prices are typically quoted in a specified currency (e.g., USD, EUR, CNY). You may be responsible for bank transfer fees, currency conversion differences, or fees charged by third-party payment platforms.
6. Cancellations, Changes, and Refunds
All requests to cancel, change a booking, or obtain a refund are subject to our Refund Policy, which forms an integral part of these Terms. Please read the Refund Policy carefully, as it details cancellation timeframes, fees, and refund eligibility.
7. Traveler Responsibilities and Conduct
- Documents: You are responsible for ensuring you and your party members possess valid passports, visas (where required), and any other necessary travel documents with sufficient validity. Our visa information is for assistance only; we are not responsible for visa application outcomes.
- Insurance: We strongly recommend you purchase comprehensive travel insurance covering medical expenses, trip cancellation, lost luggage, and personal liability. We are not liable for any loss, injury, or damage you may incur during your trip.
- Conduct: You agree to comply with all applicable laws, regulations, and local customs in China during your trip. We reserve the right to terminate services without refund if a Traveler’s conduct is disruptive, jeopardizes group safety, or impedes the tour’s operation.
- Health and Safety: You are responsible for selecting tours suitable for your health condition and informing us of any significant health issues that may affect the tour at the time of booking.
8. Limitation of Liability
- Third-Party Services: We act as an intermediary between you and various service suppliers (hotels, airlines, restaurants, attractions, local operators, etc.). We are not liable for the acts, omissions, service failures, quality issues, or any direct, indirect, incidental, special, or consequential damages caused by these third-party suppliers, except where mandatory law dictates otherwise.
- Force Majeure: We are not liable for itinerary changes, delays, or cancellations caused by circumstances beyond our reasonable control (“Force Majeure”), including but not limited to natural disasters, war, civil unrest, strikes, government actions, pandemics, weather conditions, transportation delays, or mechanical failures. In such cases, we will endeavor to assist with alternative arrangements but do not guarantee refunds.
- Maximum Liability: To the fullest extent permitted by law, our total cumulative liability to you for any claims shall not exceed the total fees you paid to us for the specific tour product giving rise to the claim.
9. Intellectual Property
All content on the Website, including text, graphics, logos, images, software, and tour designs, is our property or that of our licensors, protected by copyright and other intellectual property laws. You may not copy, distribute, or create derivative works without our express written permission.
10. Termination
We may suspend or terminate your access to the Website and Services at our sole discretion, for any reason, including violation of these Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People’s Republic of China. Any dispute arising from these Terms or the Services shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the competent people’s court in the city where our principal place of business is located.
12. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect.
- Entire Agreement: These Terms (including the referenced Privacy Policy and Refund Policy) constitute the entire agreement between you and us regarding the Services, superseding any prior oral or written agreements.
- Modification Right: We reserve the right to modify these Terms at any time. The modified Terms will be effective immediately upon posting on the Website. Your continued use of the Services signifies your acceptance of the modified Terms.
